1. Overview
Plat Tools Inc. (“we,” “us,” and “our”) respects your privacy and is committed to protecting it through compliance with this Privacy Policy (“Privacy Policy”). This Privacy Policy does not apply to data subjects of our customers whose Personal Information we may receive pursuant to Plat Tools services we provide to our customers. Our customers use PlatFunnels to store and process their own customers’ Personal Information, such as to: (i) create their own websites and applications; (ii) offer or provide their own products and services; (iii) send electronic communications; and (iv) otherwise collect, use, share or process Personal Information. In these cases, we act as a processor and service provider when providing these services to our customers (the “Processor Services”). When you give your data to one of our customers or when we collect your Personal Information on their behalf in connection with our Processor Services, our customer’s privacy notice, rather than this Privacy Policy, will apply to our processing of your Personal Information.
Please read this Privacy Policy to understand our policies and practices regarding your Personal Information and how we will handle it. If you do not agree with our policies and practices, do not use PlatFunnels. By accessing or using PlatFunnels, you agree and consent to this Privacy Policy.
2. Information That Plat Tools Collects About You
We collect information about you (“Personal Information”):
Directly from you when you provide it to us.
When you subscribe to a newsletter, create an account, make a purchase or request information from Plat Tools, we will ask for things like your name, contact (including email address and phone number), billing, shipping and communication information, and account ID or credentials in order to fulfill your request. If you set up an appointment with us through PlatFunnels, attend a trade show or event, or otherwise contact us, you may also provide similar information. If you submit any Personal Information about other people to us or to our service providers, you are responsible for making sure that you have the authority to do so and to allow us to use their Personal Information in accordance with this Privacy Policy (for example, by you obtaining their consent).
From third parties.
We obtain information through marketing partners (such as advertising and marketing companies, marketing affiliates, and social media platforms), vendors (such as data set and information vendors), and suppliers and other third parties (such as hosts or vendors at events or trade shows, public database providers, or research partners). We might also obtain information through a partner, or co-create datasets with a partner, as part of our business operations.

3. How Plat Tools Uses Information It Collects About You
We use Personal Information that we collect about you or that you provide to us for the following purposes:
For Functionality and Development of PlatFunnels.
We use your Personal Information to deliver, personalize, and improve PlatFunnels, including user account administration, billing, payment collection, and providing software updates.
To Provide AI Features:
Some PlatFunnels features may leverage artificial intelligence (“AI”) tools to enhance performance capabilities. Our use of AI is designed to provide direct services to you. We do not use your Personal Information to train generalized, public AI models. We work with specialized AI subprocessors and our instructions limit their use of your data to the provision of the specific service you are using.
For Customer Support.
We use your Personal Information to provide you with customer support for PlatFunnels.
For Business Operations.
We use information to operate our business; for example, to perform accounting, auditing, billing, reconciliation, and collection activities, or comply with contractual obligations.
To Communicate.
We use Personal Information to communicate with you about PlatFunnels, service updates, system alerts, policy revisions, and transactional messages.
To Protect and Secure PlatFunnels:
We may use information to keep PlatFunnels safe, such as crime or fraud monitoring and prevention or cybersecurity efforts.
For Advertising and Marketing.
We use Personal Information to share promotional content, conduct marketing campaigns, and advertise services that align with your business interests, subject to applicable consent frameworks.
For Statistical Purposes to Improve PlatFunnels.
We analyze aggregate engagement, performance telemetry, and platform activity to generate statistical diagnostics and enhance the speed and resilience of PlatFunnels.

We may use Personal Information to comply with legal, regulatory, or related obligations, including to protect our legal rights.
LEGAL BASIS FOR OUR USE
Certain data protection laws (such as those for example, in the European Economic Area (EEA), the United Kingdom (UK), and Brazil) require us to identify a valid legal reason (called a “legal basis”) before we collect, use, share or otherwise process your Personal Information. Our legal basis for collecting and using the Personal Information described above will depend on the Personal Information concerned and the specific context in which we collect it.
However, we will collect Personal Information from you only where we have your consent to do so, where we need the Personal Information to perform a contract with you, where we have a legal obligation to do so, or where the processing is in our legitimate interests (such as processing for administrative purposes, direct marketing, product development or improvement, preventing fraud or criminal acts and in support of information security) and not overridden by your data protection interests or fundamental rights and freedoms.

Plat Tools is the Data Controller of all Personal Information collected through PlatFunnels in the EEA and the United Kingdom, except with respect to the Processor Services (where Plat Tools is the Data Processor) or where a supplemental Privacy Policy says otherwise. 4. How Plat Tools Protects Your Information
We take reasonable and appropriate administrative, technical, and physical measures designed to protect Personal Information from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction, taking into account the risks involved in the processing and the nature of the Personal Information.
Unfortunately, the transmission of information via the internet is not completely secure. Although we take reasonable steps to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted through PlatFunnels. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on PlatFunnels.

We may share Personal Information within our corporate group of companies for purposes consistent with this Privacy Policy.

We may share your Personal Information for other purposes disclosed to you with your consent or at your direction.
SMS & Telephony Privacy Commitment
We do not share your phone number, text messaging originator opt-in data, or consent with any third parties, excluding aggregators and providers of the text messaging services.
6. Data Retention
We retain Personal Information only for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, establishing or defending legal claims, or for fraud prevention purposes.
To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal requirements.
7. Information From Children
PlatFunnels is not directed to, and we do not knowingly collect Personal Information from, children under the age of 16 (or older depending on applicable legal age requirements in specific jurisdictions). If we learn we have collected or received Personal Information from a child without verification of parental consent, we will delete that information immediately. If you believe we might have any information from or about a child, please contact us using the contact details provided below.
8. Links to Other Websites and Services
PlatFunnels may contain links to other websites and services that are not owned or controlled by Plat Tools. This Privacy Policy applies only to information collected by PlatFunnels. We are not responsible for the privacy practices of such other websites or third parties. We encourage you to be aware when you leave PlatFunnels and to read the privacy policies of each and every website or service that collects Personal Information.
9. Do Not Track
Some web browsers may transmit “do-not-track” signals to the websites and other online services with which the browser communicates. There is no industry standard that governs what, if anything, websites should do when they receive these signals. Plat Tools currently does not take action in response to these signals.
10. YOUR LEGAL RIGHTS
Depending on your location and applicable data protection laws, you may have specific rights regarding your Personal Information. These may include rights to access, correct, update, or request deletion of your Personal Information; object to processing of your Personal Information; ask us to restrict processing of your Personal Information; or request portability of your Personal Information.

We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws. We may require you to verify your identity before responding to your request.

If you are a resident of the European Economic Area (EEA), the United Kingdom (UK), or Switzerland, you have the following data protection rights under the General Data Protection Regulation (GDPR) and corresponding UK and Swiss legislation:
Access, Portability, Correction, Deletion
You have the right to request access to your Personal Information, request correction of any inaccurate data, request erasure under certain conditions, and request the transfer of your data to another controller in a structured, commonly used format.
Right to Object & Restrict
You have the right to object to our processing of your Personal Information based on our legitimate interests, direct marketing, or for statistical purposes, and to request restriction of processing in specific statutory circumstances.
Right to Withdraw Consent
If we process your Personal Information on the basis of your consent, you have the right to withdraw your consent at any time. Withdrawal does not affect the lawfulness of processing conducted prior to withdrawal.

You can opt out of receiving promotional communications from us by following the unsubscribe instructions contained in our emails or by contacting our Data Protection Officer.
Supervisory Authority Complaints & ADR Redress
You have the right to complain to a data protection authority about our collection and use of your Personal Information. In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, Plat Tools commits to refer unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF to JAMS, an alternative dispute resolution provider based in the United States. If you do not receive timely acknowledgment of your DPF Principles-related complaint from us within 45 days, or if we have not addressed your DPF Principles-related complaint to your satisfaction, please visit https://www.jamsadr.com/eu-us-data-privacy-framework for more information or to file a complaint. The services of JAMS are provided at no cost to you.
12. U.S. Privacy Rights
This section applies to residents of California, Virginia, Colorado, Connecticut, Utah, and other U.S. states with comprehensive consumer data privacy laws. These laws grant consumers specific rights regarding their Personal Information:
Right to Opt Out of Sale, Sharing, and Targeted Advertising:
You have the right to direct us not to sell your Personal Information or share it for cross-context behavioral advertising.
Rights to Access, Correction, and Deletion:
You have the right to request access to the specific pieces and categories of Personal Information we have collected about you, correct inaccuracies, and request deletion of your Personal Information.
Right to Non-Discrimination:
We will not discriminate against you for exercising any of your privacy rights.
Right to Appeal:
If we deny your request, you have the right to appeal our decision by following the instructions provided in our response.
Authorized Agent:
You may designate an authorized agent to make a request on your behalf subject to written verification.
Sensitive Data & Automated Profiling:
We do not use or disclose sensitive personal information for purposes other than those permitted by applicable law, nor do we engage in profiling that produces legal or similarly significant effects.
Sensitive Data & Automated Profiling:
In the preceding 12 months, Plat Tools has collected the following categories of Personal Information:
Identifiers (such as name, email address, IP address, and unique online identifiers);
Commercial Information (such as transaction records, products purchased or considered);
Internet or Other Electronic Network Activity Information (such as browsing history, interaction logs);
Geolocation Data (approximate physical location derived from IP);
Professional or Employment-Related Information (such as business entity, title, business phone);
Inferences drawn from any of the above to create a profile reflecting preferences and behavior.
We collect this information for the business and commercial purposes described in Section 3 of this Privacy Policy. We disclose these categories of Personal Information to the categories of third parties described in Section 5.
Categories Sold or Shared: We do not “sell” Personal Information in exchange for monetary consideration. However, we may “share” identifiers and internet network activity with third-party advertising partners for cross-context behavioral advertising. You have the right to opt out of such sharing. As reaffirmed: We do not share your phone number, text messaging originator opt-in data, or consent with any third parties.
13. Australian Privacy Rights
If you are located in Australia, we handle your Personal Information in accordance with the Australian Privacy Principles (“APPs”) set out in the Privacy Act 1988 (Cth).
Data Subject Rights:
You have the right to request access to and correction of your Personal Information held by us. We will respond to your request within a reasonable period, typically within 30 days.
Complaints:
If you believe we have breached the Australian Privacy Principles, you may contact our Privacy Officer at [email protected]. We will investigate your complaint and respond within 30 days. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (“OAIC”) via https://www.oaic.gov.au/about-us/contact-us.
14. Canadian Privacy Rights
If you are located in Canada, our collection, use, and disclosure of your Personal Information complies with the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and applicable provincial legislation (including British Columbia, Alberta, and Quebec Law 25).
Data Subject Rights:
You have the right to request access to the Personal Information we hold about you and request that any inaccurate information be amended. We will respond to your request within 30 days.
Withdrawal of Consent:
You may withdraw your consent to our collection, use, or disclosure of your Personal Information at any time, subject to legal or contractual restrictions and reasonable notice.
Quebec Residents:
Residents of Quebec have specific rights under Law 25, including the right to data portability, the right to de-indexing, and enhanced protections around automated processing and international transfers.
15. International Data Transfers
Plat Tools Inc. is based in Canada and operates globally. Your Personal Information may be transferred to, stored, and processed in countries other than the country in which you reside, including the United States, Canada, and India, where our servers, affiliates, and service providers are located.
These countries may have data protection laws that differ from the laws of your country. However, we have taken appropriate safeguards to require that your Personal Information will remain protected in accordance with this Privacy Policy and applicable data protection laws. These include implementing Standard Contractual Clauses (SCCs) approved by the European Commission and the UK International Data Transfer Addendum, ensuring third-party providers adhere to equivalent security baselines, and complying with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF).
Plat Tools is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC) with respect to our compliance with the DPF. In cases of onward transfer to third parties of data of EU, UK, and Swiss individuals received pursuant to the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, Plat Tools remains liable.
16. Data Privacy Framework
Plat Tools Inc. complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union, the United Kingdom, and Switzerland to the United States.
Plat Tools has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. Plat Tools has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF.
If there is any conflict between the terms in this Privacy Policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. Plat Tools is committed to notifying individuals without undue delay if a data security incident occurs that poses a high risk to their rights and freedoms.

We may update this Privacy Policy from time to time in response to changing legal, technical, or business developments. When we update our Privacy Policy, we will take appropriate measures to inform you, consistent with the significance of the changes we make. We will obtain your consent to any material Privacy Policy changes if and where this is required by applicable data protection laws.
